Please read the following terms and conditions (“Terms of Service”, “Terms”), carefully before using this Site or subscribing to the services ("Service") so that you are aware of your legal rights and obligations with respect to Diet Ideas Sdn. Bhd. (Company Registration No. 201901023252 (1332581-H)), its affiliates and/or subsidiaries (individually and collectively, "Diet Ideas", "we", "us" or "our"). The "Services" we provide or make available include (a) the Site, (b) the services provided by the Site and by Diet Ideas application software (“App”) made available through the Site, and (c) all information, linked pages, features, data, text, images, photographs, graphics, music, sounds, video (including live streams), messages, tags, content, programming, software, application services (including, without limitation, any mobile application services) or other materials made available through the Site and App or its related services ("Content"). Any new features added to or augmenting the Services are also subject to these Terms of Service. These Terms of Service govern your use of Services provided by Diet Ideas.

By using our App and/or Site and/or subscribing to any features of the application and/or website, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein. These Terms of Service apply to all users of the application and/or website, including without limitation users who are browsers, subscribers and/ or contributors of content.

Right To Make Changes To The Agreement

Please note that these terms and conditions may be amended from time to time in accordance with applicable laws and regulations and such variations may be applicable to you. In the case of any changes, you will be notified, and the latest version of this Term and Agreement will be made available to all customers.

By registering for access to the Site or the Application and use of the Services, you agree to abide by the following terms and conditions:

  • You accept that any information provided by us is general information and is not in the nature of advice. We derive our information from sources which we believe to be accurate and up to date as at the date of publication and reserve the right to update this information at any time.

All trademarks, logos, images, and service marks, including these Terms and Condition as displayed on the Website or application or in our marketing material, whether registered or unregistered, are the intellectual property of Diet Ideas Sdn Bhd and/or third parties who have authorized us with the use (collectively the “Trademarks”). You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Trademarks in any way without our prior express written consent. The use of Diet Ideas Sdn Bhd trademarks on any other website not approved by us is strictly prohibited. Diet Ideas Sdn Bhd will aggressively enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution.

Governing Law

This Agreement shall be governed by the laws of Malaysia and the courts of Malaysia shall have non-exclusive jurisdiction. For users outside of Malaysia, the respective laws of your country shall be applicable. Should there be any contradiction in the laws of your country or province of residence, laws of Malaysia shall prevail.

Limitation Of Liability

You acknowledge and agree that Diet Ideas shall not be liable to you or your beneficiaries for any losses, claims, costs, expenses or damages arising out of or in connection with your use of and/or reliance on the Services, or any termination of your access to the Services, whether arising from the negligence, default, act or omission of Diet Ideas and/or its affiliates and/or their respective employees, officers, contractors and/or agents or partners.

Indemnification

You agree to indemnify us against any loss, damage or cost incurred by us arising out of your access or use of the Site, including, without limitation, the Services, the Application, the Content or any other information accessible over or through the Site and/or the Application, any content submitted by you or your violation of these terms and conditions, or any other laws, regulations and rules. You will also indemnify us against any claims that information or material which you have submitted to us is in violation of any law or in breach of any third party rights (including, but not limited to, claims in respect of defamation, breach of confidence, infringement of copyright or infringement of any other intellectual property right).

Acknowledgement

The user, client or subscriber, (the "User") acknowledge that while Diet Ideas Sdn Bhd (referred as Diet Ideas) personalised health program aims to be inclusive, this product should not serve as a replacement to my primary healthcare provider and is not intended to mainly diagnose, treat, or cure any physical illness or psychological disorders. the user understand the role of dietitians and nutritionist in Diet Ideas will be following the legal role according to the Allied Health Sciences act, whereby dietitians will help to improve and cure client’s health conditions using medical nutrition therapy and nutritionist will help to prevent possible health conditions during the program with Diet Ideas.

The user acknowledge and agree that Diet Ideas reserves and retains the right to picture record, video record, audio record and process all interactions. All recordings are the sole property of Diet Ideas. Recorded interactions are used for developmental, research, analytics, improvement and monitoring purposes. Diet Ideas may also use all or any part of the information recorded (or derivatives of such information) to improve its service, by means of processing the recorded data to train Machine Learning (ML) models that will improve our staff. This also includes allowing Diet Ideas personnel or third parties with technical expertise to listen to, watch, and perform analysis with or process data recorded from video calls, audio call, chats message or recordings in connections with the Services (or any improvement thereof). While using Diet Ideas services, The user agree for any resources shared with Diet Ideas, to be used for the marketing purposes for Diet Ideas. The user understand that Diet Ideas will ask for my consent shall my sensitive data such as health improvement with my name to be used for marketing purposes.

The user acknowledge that for any purchase of Diet Ideas consultation and product, payment is to be made first before the service can ensue.

The user hereby agree that in using Diet Ideas Services, the user shall not in any circumstance commit any of the following prohibited conduct which the user acknowledge would constitute a serious breach of Diet Ideas Terms of Use:-

  • Use words that constitute or which can be considered to constitute verbal abuse;
  • Send/transmit any obscene/disturbing materials;
  • Send/transmit any materials which constitute or encourage conduct that would be considered a criminal offence in Malaysia or any other country;
  • Use any words and/or send/transmit any materials that are discriminatory or derogatory, including on the basis of someone’s race, religion, age, gender, disability or sexuality; and/or
  • Send/transmit any materials that contain a threat of any kind, including threats of physical violence

 

The user hereby acknowledge and agree that Diet Ideas reserves the right to suspend and/or terminate the services provided to the user at any time upon reasonable grounds, which will effectively result in the user inability to use Diet Ideas Services. The user also hereby acknowledge and agree that in the event of any breach of Diet Ideas terms and conditions, Diet Ideas may in its absolute discretion suspend and/or terminate the services provided to the user immediately without notice.

The user acknowledge and agree that Diet Ideas shall not be liable to the user or its beneficiaries for any losses, claims, costs, expenses or damages arising out of or in connection with The user use of and/or reliance on the Services, or any termination of The user access to the Services, whether arising from the negligence, default, act or omission of Diet Ideas and/or its affiliates and/or their respective employees, officers, contractors and/or agents or partners.

The user hereby agree to indemnify and hold harmless Diet Ideas and its affiliates, and their respective employees, officers, contractors, partners and agents from any liability, losses, claims, costs, expenses or damages that Diet Ideas may suffer or incur as a result of, in connection with or arising out of my participation in any event or activity by Diet Ideas, and/or the use of the Services.

By clicking 'SUBMIT' or purchased any Diet Ideas package/program or informing Diet Ideas staff through Chat messages, audio call or video call to proceed the Services, The user acknowledge and agree that these terms and conditions will both govern the user use of the Services and form part of the contract between The user and Diet Ideas.

Privacy and Personal Data Protection

Diet Ideas abides by the Personal Data Protection Act 2010 ('The Act') which requires us to inform you of your rights in respect of your personal data that is being processed or that is being collected and further processed by us and the purposes for the data processing. The Act also requires us to obtain your consent to the collection and processing of your data that enables us to perform, analyse and improve our services, offer our services and communicate with you. We will use this data to provide you with the Services requested, to maintain our records and/or to send you relevant information.

By signing up to the Diet Ideas programme and using Diet Ideas Services, The user hereby consent for my personal data (including sensitive data) to be collected and processed, and confirm that The user agree to Diet Ideas privacy policy. All the information provided here by me is correct.

By providing sensitive data such as health diagnosis, blood test, DNA test to Diet Ideas, The user understand that Diet Ideas will not be responsible for any breach of data caused by uncontrolled or unfortunate events. The user also understand, that Diet Ideas will take fully responsible in protecting the data within their power.

Blue Members Subscription Terms and Condition

Cancellation Policy

By subscribing to our services, you agree to adhere to the following cancellation policy. If you decide to cancel your subscription within the first 6 month, you will be subject to a cancellation fee equivalent to one month's subscription fee.

Refunds

The cancellation fee is non-refundable, and no refunds will be provided for any unused portion of the subscription term.

Changes to Terms

Diet Ideas reserves the right to modify or update these cancellation terms at any time. Subscribers will be notified of any changes via email or through our mobile apps, and the updated terms will become effective 30 days after the notification.

By continuing with your subscription, you acknowledge that you have read, understood, and agreed to the terms outlined above.

Chats with Diet Ideas Sdn Bhd dietitian or nutritionist are only accessible internally within the Diet Ideas Sdn Bhd dietitian or nutritionist team. The dietitian or nutritionist team is bound by duties of confidentiality with respect to your personal data.

Diet Ideas Sdn Bhd uses data security, encryption and storage systems to safeguard all data.

We, at Diet Ideas Sdn Bhd, are committed to the protection of your Personal Data and place the matter of protecting your privacy as our utmost priority. Collection and Processing of Personal Data

We hereby inform you that we (Diet Ideas Sdn Bhd, ‘Website’), Diet Ideas Sdn Bhd (1332581-H). and each of our respective related corporations (hereinafter referred to as the “Company”, “we”, “our” or “us”) (whether or not controlled by us) have or will collect, record, hold, store, use, disclose and/or process (collectively referred to as “Process”) one, or all of the following categories of personal information about you:

  • master data: name, gender, date of birth, citizenship, nationality;
  • contact details: home address, correspondence address, billing address, home phone number and mobile number, e-mail address, work address, work number;
  • compensation / payment details: bank account details, credit card details, banking information, credit records
  • verification details: information pertaining to the verification of identity, including identification type, NRIC No., and identification number;
  • Health information, e.g. height, weight, family medical history, chronic disease history;
  • Other information, e.g. resumes or CVs when applying for a job at the Company;
  • Other information you voluntarily provide through free text input forms, multiple type questionnaires, chats or other means.
  • data relating to online session: browser type and version, operating system, domain name; and
  • any such information as we deem necessary or appropriate from time to time in connection with your commercial relationship with us. (collectively, “Personal Data”).
  • Data shared via Google-based signups are members' names and email addresses. The purpose, collection and processing of it adhere to the purpose, collection and processing of personal data as stipulated here.

To the extent that you disclose to us any personal information above of any individual, we shall assume that you have obtained such individual’s consent for the disclosure as well as the Processing of the same in accordance with the terms of this notification (“Notification”).

Your Personal Data has and / or will be obtained from the following sources, where applicable, or such other sources which we may see fit from time to time:

  • information provided or submitted by you through among others, the use of our website, social media and phone applications;
  • information gathered through promotional activities;
  • cookies that your web browser store on your computer when you visit a website;

  • any person to whom we are, in our belief in good faith, under an obligation to make disclosure as required by any applicable law;
  • government agencies, statutory authorities and industry regulators;

  • our subcontractors or third party service or product providers as may determine to be necessary or appropriate.

In addition, your personal information may also be disclosed under the following circumstances

  • Under discretion, if it is decided that disclosure of information is necessary as there is a threat to your health, safety or life, or that of other individuals. 

In the case of minors, under the Child Act (2001), Diet Ideas Sdn Bhd is mandated to report individuals who are:

  • suspected to be physically or emotionally injured as a result of ill-treatment;
  • suspected to be subject to neglect or abandonment.
  • Except for Personal Data which is Processed for direct marketing purposes as well as those set out above, it is obligatory for you to provide certain categories of Personal Data which we request from you for the said Purpose. Failure to supply and consent to the Processing of the Personal Data in relation to the Purpose will:
  • result in us being unable to provide you with the information, notices, services and/or products requested; and
  • affect the ability of the parties to enter into the necessary agreement in relation to the provision of our services to you.
  • It is optional for you to provide the categories of Personal Data which we request from you for direct marketing purposes.
     
Your Rights of Access and Correction

You have the right to request access to and/or correct your Personal Data and/or limit the Processing thereof. In this respect, you may:

  • check whether we hold or use your Personal Data and request access to such data;
  • request that we correct any of your Personal Data that is inaccurate, incomplete or out-of-date;
  • withdraw, in full or in part, your consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period.

Please note that depending on the information requested and where permitted by law, a nominal administrative fee may be charged. We will endeavour to provide the information back to you as soon as practicable; however we also reserve the right to validate all requests for the authenticity of the request. However, Diet Ideas Sdn Bhd has the right to deny access to personal information and data at the Dietitian or Nutritionist discretion:

  • that access to this information will pose a serious threat to the life, health or safety of the individual involved or any other individual;
  • the request for information is frivolous or vexatious; in which case the individual will be asked for a reason for the need to access this information.

We will retain your Personal Data for only as long as necessary to serve the purposes set out in this privacy policy and Personal Information Collection Statement in compliance with all statutory and regulatory requirements in Malaysia, for no longer than 1 year from the moment of latest consent obtained through registration or using the service concerning the retention of Personal Data. We will take reasonable steps to destroy or permanently anonymize Personal Data if it is no longer needed for such purposes.

Job Applicants

Personal Data provided in connection with an application for employment will be used to determine your suitability for a position with the Company and, if applicable, your terms of employment or engagement. Your information may also be used to monitor our recruitment initiatives and equal opportunities policies.Your details may be disclosed to third parties to verify or obtain additional information including education institutions, current/previous employers and credit reference agencies. Refund Policy

  • All transactions once completed cannot be cancelled, exchanged, or refunded under any circumstances. All Package(s) or Program(s) on the Website are offered subject to availability. No requests for refunds, cancellation, or exchanges of any kind will be entertained.
  • Package(s) or Program(s) purchased shall be redeemable only for the services specified, and shall only be available for redemption before 31st December 2024.
  • Package(s) or Program(s) purchased cannot be exchanged or redeemed for cash.
  • Package(s) or Program(s) purchased cannot be combined with any other Voucher, discount or promotional offer unless otherwise specified.
  • Package(s) or Program(s) purchased may contain terms and conditions that supplement, and are to be read as in addition to, these Terms and Conditions. In the event of any inconsistency between the Package Terms and these Terms and Conditions, the Package Terms shall prevail.
  • All services redeemable by Package(s) or Program(s) purchased are subject to availability. Diet Ideas Sdn Bhd does not guarantee that the services redeemable by Package(s) or Program(s) purchased will be available at your preferred date and time.
  • A representation on the Site that services will be available over a range of dates does not preclude you from being required to make an appointment to redeem the services. Appointments must be made at least 3 days in advance.
  • Diet Ideas Sdn Bhd reserves the right to cancel and reschedule your appointment or booking. Except as required by law, the Company will not be held liable for such events and are not liable to reimburse you for any travelling, accommodation or other loss or expenses suffered or incurred by you or any other person due to any cancelled or rescheduled appointment or booking."

Terms & Condition Between Diet Ideas Sdn. Bhd. & Payer For Instalment Payment of Service Provided

This contract is made effective immediately, once the first payment is made between Diet Ideas Sdn Bhd (hereinafter referred to as “the company”) and client (hereinafter referred to as the “Payer”) for the purpose of setting forth the terms and conditions for the payment of RM (full amount).

Payment Details

Full amount shall be paid by the Payer to the Company in two installments as follows:

  • First Payment - The Payer shall pay the agreed amount as per discussion by the company and the payer before commencement of the service.
  • Second Payment - The Payer shall pay the remaining balance of the payment to The company on the agreed timeline by the company or before the expiration of the program purchased.
  • The company only accepts online payment and does not accept cash payment. 
 
Default

If the Payer fails to make the second payment by the specified due date, the Company reserves the right to pursue legal action to recover the outstanding amount, and the Payer shall be liable for all costs and expenses associated with such action.

Termination of Contract

This Contract is terminated automatically upon the Payer’s successful completion of outstanding payments.

Governing Law

This contract shall be governed and construed in accordance with the laws of Malaysia.

Legally Binding

The Payer is legally binding to this contract agreement without the need of his or her signature upon purchasing the Company service or product where he or she chooses for “Installment Payment” option.

Entire Agreement

This Contract constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, whether oral or written. Both parties are automatically bound into the contract in the event of installment payment made and no signatures are required.
